The charges come from a press report published by Germany’s Bild newspaper, which states that the men had been arrested in 2004 on suspicion of smuggling five pounds of heroin from Pakistan into Spain and was sentenced to five years in prison.
The men were being held at the prisons of the Spanish-run Briansko-Tatry state prison in north-eastern Poland. The prisoners allege they were tortured in an effort to force confessions. Their two sets of parents were allowed to visit the prisoners two weeks ago and were able to make contact with their sons during the visit.
The father of Samir Ferjani denies the allegations and explained that his son was arrested after he and his wife were caught driving a minibus that the driver knew to be used by drug traffickers. The family alleges that they would not have been in a position to pay the cost of the vehicle had they been able to buy a new one. The men were detained in prison for five months before being deported to Saudi Arabia.
A statement was issued by the German Embassy in Warsaw expressing regret over the alleged beatings. Polish authorities said that they were investigating the case and that in the event that the allegations were substantiated they would open a criminal investigation into the torture of the men.
Ferjani and Al-Wihani are being held in the same prison as several other men from North Africa, including Libyan, Nigerian and Moroccan nationals. The men allege that there are four other Libyan prisoners on the same floor of the prison who have been beaten in order to force confessions.
The family of the 56 year old Yemeni veteran of the war against the Soviet forces in Afghanistan, Jamal Al-Wihani, filed a similar complaint
